PUBLIC NOTICE No. - 40/2006

Subject – Procedure for the disposal by auction of seized, confiscated and time-expired goods.

 

 

It is notified for the information of general public that the following procedure shall be followed with immediate effect for the disposal by auction of seized, confiscated and time-expired goods by the Office of the Commissioner of Customs, Kandla, Gandhidham, Distt: Kutch.

(i) The disposal will be electronic auction (e-auction) which will be held on a notified date and time.

(ii) The prospective bidder for e-auction shall obtain registration on payment of a fee of Rs. 5,000/-(out of which Rs.4,900/- is refundable) and on filing the details in the prescribed form, which may be obtained from the Disposal Section of this office or downloaded from the website of this Custom House (www.kandlacustoms.org).

(iii) The e-auction will take place on the Kandla Customs website (www.kandlacustoms.org) and an auction site could be accessed during the day and time notified for the purpose. The prospective bidders will be allotted the login ID and Password upon registration.

(iv) The details of the lots placed on e-auction will be placed on the Kandla Customs Website and on Customs House Notice Board at least 3 working days prior to the date of auction. The goods will also be available for inspection by prospective bidders.

(v) The e-auction will be closed at the end of the time notified for the purpose. The bids of e-auction will be tabulated in the presence of witnesses.

(vi) The results of e-auction will be announced after two hours of the close of the auction.

(vii) Within 7 days of the receipt of the letter indicating acceptance of the bid by the department, the successful bidder is expected to pay the EMD or the full bid amount according to his preference and shall take delivery of the goods after full amount is paid within time limit as specified in the conditions of sale, failing which the EMD is liable to be forfeited.

(viii) To enable the bidders, who are not familiar to participate in internet auction, facility of submitting a sealed tender to the Assistant Commissioner (Disposal) one day prior to the date on which that bid is being put in internet auction cum tender, is available. The format for this purpose is given in the “HELP” icon of the e-auction of www.kandlacustoms.org. The tenders, which do not contain all the details or are not accompanied by DD, shall be rejected. Sealed tenders will be opened on the next working day after the end of internet auction for that month between 1100 hrs to 1200 hrs in the chamber of AC/DC (Disposal). Interested bidders can witness the tender opening.

2. The Commissioner of Customs may withdraw any lot from the auction at any time or cancel the same at any stage prior to the delivery of the goods without assigning any reason.

3. All the Trade Associations/Chamber of Commerce/Members of Regional Advisory Committees and Custom House Agents’ Association are requested to publicize the contents of this Public Notice among their members/constituents.
