PUBLIC NOTICE NO. 03/2009

Sub: Examination norms for goods exported under Reward Schemes - regd..

           

   Attention of all concerned officers and trade is invited to the Board’s Circular No. 1/2009-Cus., dated 13.01.2009 issued from the F. No. 450/151/2008-Cus. IV, by the Director (Customs), CBEC, New Delhi regarding the subject matter, copy of which is enclosed herewith for information, guidance and strict compliance.

 

2.1          As provided under the above circular, the exporters who want to claim export incentives viz. VKGUY, SFIS, FPS, FMS, etc. under chapter 3 of the FTP against the Free Shipping Bills should invariably state the intention to claim such benefit at the time of export by declaring on the Free Shipping Bills as under:

 

“I/We, hereby, declare that I/We shall claim the benefits, as  admissible, under Chapter 3 of FTP”.   

 

               The exports made on Free Shipping Bills where the exporter is claiming benefits of only schemes under chapter 3 of FTP shall be governed by the examination norms given in the above circular.

 

2.2          However, if the export is made claiming benefits of Drawback/ DEPB/ or any other export promotion scheme in addition to claiming benefits under any schemes of chapter 3 of FTP, then the examination norms as prescribed by the Board for the respective export promotion schemes would apply.

 

2.3          If the exports are made on free shipping bills without any declaration of any claim under Chapter 3 of FTP, the existing norms of “no examination except where there is specific intelligence” would continue to apply.

 

3.            In terms of Board’s above circular, the relevant portion of Board’s circular no. 6/2002 – Cus. Dated 23.1.2002 stands amended.  The Public Notice no. 11/2002 dated 12.02.2002 issued by this office stands amended up to the extent as discussed above.

 

               The revised examination norms under the Reward Schemes will be implemented w. e. f. 01.02.2009.

 

4.            Any difficulties faced in implementation of the above Circular may be brought to the notice of the undersigned immediately.

 

5.         All the Trade Associations/Chamber of Commerce/Members of Regional Advisory Committees and Custom House Agents’ Association are requested to publicize the contents of this Public Notice among their members/constituents.
