PUBLIC NOTICE NO. 10 /2007

        Sub. :  Dispense   with  practice  of  revenue   deposit  of

                    Rs. 3000/- under Section 42 of Customs Act, 1962.

                                -----------------------------------------------------------------------

           

                Attention of all Custom House Agents, Importers, Exporters, Shipping Agents, Members of Regional Advisory Committees and Members of the Trade is invited to the Board’s letter F.No. 450/10/2007-Cus dated 13.02.2007 (enclosed) on the above subject.  The Central Board of Excise & Customs had earlier issued instructions vide F.No. 28/12/70-Cus dated 22.05.1970 regarding security deposit in respect of foreign going and coastal vessels under Section 42 of Customs Act, 1962. Accordingly, the quantum of deposit of Rs. 3000/- and 1000/- is taken from foreign vessels and coastal vessels respectively to cover the liabilities of individual vessels. When shipping lines handle a number of vessels, a one time deposit of Rs. 15000/- and 5000/- is taken for the foreign going and coastal vessels respectively.

 

                As per Section 42 of Customs Act, 1962,  the vessel is permitted to depart from a customs station by the proper officer after considering that the person in charge of the conveyance has complied with-

 

i.                   Production of specified documents and replied the question, if any,

ii.                 Delivery of export manifest

iii.              Payment of all duties leviable on any stores consumed in the

          conveyance

iv.                Payment of all charges and penalties due in respect of the conveyance

v.                  No penalty is leviable on the person in charge under Section 116 of Customs  Act, 1962 for deficiency of goods

vi.                Export goods contravening any provisions of the Customs Act have been  unloaded.

         The Board has considered that procedure for taking a deposit initially and refunding it each time the vessel enters and departs the port involves avoidable administrative inconvenience and delay in repayment of deposit. In view of this, and as a trade facilitation measure, Board has desired that such security amount may not be taken. All the Trade Associations/Chamber of Commerce/Members of Regional Advisory Committees and Custom House Agents’ Association are requested to ensure that provisions of Section 42 are complied with before applying for port clearance.

           All the Trade Associations/Chamber of Commerce/Members of Regional Advisory Committees and Custom House Agents’ Association are requested to publicize the contents of this Public Notice among their members/constituents.
