Attention of all Importer, custom house agents and members of the trade is invited to the Hon'ble Supreme Court Order in the case of Commissioner of Customs (Preventive) V/s. Aafloat textiles (I) P. Ltd, reported 2009 (235) ELT (S.C.)

2.               In the instant case the Hon'ble Court has held that it is the duty of the buyer to
remain cautious, make enquiry and take requisite precaution before buying licenses from
open market. If he does not do, consequences have to follow.
3.            In terms of above, all concerned who buy licenses including all type of licences
from open market whether SIL, DEPB, DFIA, DFRC, VKGUY, Focus Product Scheme,
Focus Market Scheme or otherwise are hereby informed to exercise caution, make
enquiry and take requisite precaution before the purchase of such licences.
