Sub :- Compulsory Pre-shipment inspection and certification of certain commodities under the Export (Quality Control and Inspection) Act, 1963, prior to export.

Attention of all the officers, staff, field formations and concerned persons is invited to letter No. EIC/D (Q/C)/T-32/2011-12 dated 30.06.2011 (Copy Enclosed) from Export Inspection Council of India, New Delhi on the above subject.

1. All officers and staff concerned at the Commissionerate Headquarters and in the field formations are directed to strictly adhere to the aforesaid instructions and implement the same with immediate effect.
2. all the trade associations/ chamber of commerce/member of regional advisory committee and custom house agents association are requested to publicize the contents of this public notice among their members/ constituents for their information and necessary action.
3. Difficulties, if any, in implementation of the instruction may be brought to the notice of this office immediately.

Export (Quality Control and Inspection) Act, 1963, prior to export.               

Sir.
This refers to the Orders and Notifications issued by the Central Government under the Export (Quality' Control and Inspection) Act, 1963, w.r.t. the notified commodities intended for Export.
As you are already aware, the Export Inspection Council (EEC) was set up by the Government of India under Section (3) of the Export (Quality Control and Inspection) Act, 19.63 for sound development of export.trade of India through Quality CbntroUsi Inspection and tor matters connected therewith.
The export of the products/commodities hsted in the table enclosed as Annexure is made mandatory by the Central Government through the Orders & Notifications issued under the provisions of the Export (Quality Control and Inspection) Act 1963, for the benefit of the trade in the globalized environment especially after the establishment of WTO and signing SPS and TBT A-greements. All these Orders are statutory in nature and required to be adhered by the Exporters and the Authorities concerned., involved in the process for export of these ( commodities. The Agencies established or recognized under Section 7 of the Export (Quality j Control and Inspection) Act, 1963, for compulsory pre-shipment inspection of these notifiec I products/commodities are also listed in the enclosed Annexure.

Each Order (as mentioned in the Annexure), prohibits the export of particular product (s) i commodity in_ the course of international trade, unless a mark or seal recognized by Centre of Government indicating that it conforms to the standard specifications applicable to it, has bee affixed or applied to packages or containers and is accompanied by certriicate issued by any the agencies established or recognized under Section 7 of..the Export' (Quality Control ai Inspection) Act, 1963 (22 of 1963) to the effect that such products conforms to the standa specifications and' is exportwcrthy.

As such, any act of not adhering to the provisions of the respective Orders and Rules would
the violation of the Act.                                                                                                                        

In view of the above, the undersigned is directed to request you to bring the above informatio the attention of your field officers and an advisory may be issued to them to ensure that export of the notified commodities is permitted only if the consignments are cover-accompanied by a Certificate of Inspection / Certificate for Export issued by any of the Ager established or recognized by the Central Government, as mentioned against Product(s)/Commodiiy in the Annexure enclosed herewith.

Further, the information related Gol Orders and Notifications and other details relating to the standards applicable to it, the list of processing establishments approved for export by the Export Inspection Agencies, are available as public information on the Export Inspection Council of India website www.eicindia. org
