Annexure -IV

 

TERMS AND CONDITIONS OF THE QUOTATION / TENDER

 

 1.             Special Instructions:

  1. Bids should be submitted by the Manufacturers or their authorized distributors/ agents/ dealers.
  2. Bids  shall be submitted on Two Bid System, i.e., Technical Bid and Price Bid separately.
  3. Technical bid shall consist of all technical details along with commercial terms and conditions
  4. Price bid shall consist of item-wise price for the items mentioned in the technical bid
  5. Single copies of technical and financial bid will be submitted. The technical and financial bids will be kept in separate envelops duly sealed and super-scribed as technical bid/ financial bid along-with following details thereon.
  6. Quotation /Tender Number
  7. Name of the  sophisticated Instrument/ equipment
  8. Name of the Firm

   (vi)
Both the sealed envelops of technical and financial bids will further be placed in another bigger envelope, which will also be properly sealed.   This main envelope will also be super scribed with the following details thereon.

  1. Quotation /Tender Number
  2. Name of the  sophisticated Instrument/ equipment
  3. Name of the Firm
  1. Both the bids, i.e. Technical & Financial must be identical in all respects except that the Technical bid should have blank space at the places where prices have been stated in the Price bid. 

 

  1. Bids will be evaluated in two stages.  At the first stage, technical bids of the bidders will be evaluated.  Price bids will be opened of only those bidders whose technical bids fulfill the prescribed Technical Specification and are accepted by the Technical Committee.
  1. The bids should be addressed to Chemical Examiner Grade-I, Incharge Custom Laboratory Kandla
  2. Prices must be quoted in Indian Rupees on ex Kandla basis

 

  1. The bidder will submit the compliance statement of each and every required specification of the quoted sophisticated Instrument/equipment in the format duly signed by the bidder. 

 

2.        Terms of payment:

(i)         No advance payment will be made for the supply of the equipment.

(ii)        Payment will be released only after completion of supply, installation, commissioning, demonstration, training and satisfactory performance of the sophisticated Instrument /equipment in the laboratory duly certified by the Incharge of the Custom Laboratory Kandla. 100 % payment shall be released against the receipt of material and submission of 10% of order value as performance security to cover the warranty period. In case the performance security is not given by the bidder only 90% amount would be released and 10% would be released after the discharge of all warranty obligations.

(iii)       No interest shall be payable by the Government on delayed payment.

(iv)       The terms and conditions quoted by supplier in the tender/ quotations as well as in pre-receipted bill shall not be binding on the Department.

(v)        Payment will be made direct to the supplier through Demand Draft/ Cheque against pre-receipted bill.  No request for other mode of payment will be entertained.

 

3.           Compliance statement and Technical details:

(i)         Specifications mentioned in the bid must be reflected/ supported by the manufacturers’ printed technical leaflet/ literature of the quoted item. 

(iI)        The quoted model be highlighted in the leaflet/ literature enclosed with the quotation/ Tender.  

(iii)       Installation Qualification (IQ), Operation Qualification (OQ), Performance Qualification (PQ) documents should be supplied at the time of installation.

(iv)       The supplier must have adequate background of technical support/application in               laboratory.

(v)        Instruments/equipments must conform to accuracy, reproducibility, repeatability and     precision for their use as indicated in the specifications.

 (vi)      The cost of instrument shall include practical training for operation of the    instrument.  Training shall be imparted at the place of installation.

4.         Warranty and Annual Maintenance Contract (AMC):

(i)         Warranty period of the quoted sophisticated Instrument/ equipment should not be less than one year. 

(ii)        Warranty period will start from the date of satisfactory installation of the sophisticated Instrument/ equipment in the laboratory.

(iii)       The AMC charges for the quoted model of the sophisticated Instrument/ equipment for two years after the completion of the warranty period should be quoted.

5.         Consumables, Accessories & Spares:

(i)         All essential accessories along with spares of the quoted sophisticated Instrument/ equipment will be supplied by supplier.  The prices of these should also be quoted separately with the sophisticated Instrument equipment.

(ii)        Consumables and spares sufficient for two years after warranty period should also be quoted individually in the bid.

(iii)       The laboratory will provide only the electric supply and appropriate space (platform).  Pre-installation requirements of the sophisticated Instrument /equipment may also be specified and prices thereto be quoted.

 

6.       General:

(i)         Technical bids/ Quotations will be opened on the specified date i.e. on next day of the last date.

(ii)        The bidders/ quotations whose technical bids are qualified and accepted; only their financial bids are opened.

(iii)       Sealed Quotation/Tender would be submitted on or before the due date.  Department shall have no responsibility for delay or non-receipt of tender document by post.  Tenders received after due date and time will be rejected.

(iv)       Separate Quotation/ Tender has to be submitted for each sophisticated Instrument/ equipment, e.g. those who want to quote for more than one item should submit separate tender for each item.  

(v)        Validity of the prices of the items quoted in the tender should be for minimum period of one year from the date of opening of tender.

(vi)       The equipment should be delivered within two months from the date of award of contract.  However, bidder must quote definite delivery period of the equipment.

(vii)      Quotation/Tender should be typed/ computer written and every correction on the quotation/ tender should invariably be signed by the bidder, failing which the tender is liable to be rejected.

(viii)     Bidders will not be permitted to alter or modify their bids after submission of the bids.

(ix)       Photocopies of the recent Income Tax Clearance Certificate, Income Tax TAN No., and Sales Tax / VAT Registration No.  shall be submitted.

(x)        Bidder will submit a certificate stating that the firm has not been blacklisted in the past by Govt. / Pvt. Institutions.

(xi)       The basic price per unit of the item must be quoted.   Excise duty or any other Taxes/ levies must be quoted separately, and be included in the basic price –
of the item, separately. The quotation must indicate the CST/ ST /VAT nos. other wise will not be paid.

(xii)      Discount offer, if any, for the quoted item may also be mentioned in the quotation.

(xiii)     No other charges such as octroi,  packing, forwarding, freight, insurance, loading, unloading, etc. will be payable.

(xiv)     In respect of imported goods, the bidder shall also specify separately the total amount of custom duty included in the quoted price.  The bidder should also indicate correctly the rate of custom duty applicable for the goods in question and the corresponding Indian Customs Tariff Number.

(xv)      Bidder should sign each page of the quotation/Tender document and Annexures.

(xvi)     Department reserves the right to invite the bidders for technical discussions. Bidder should depute competent representative for such discussions whenever invited for and he should be competent to take on the spot decision.

(xvii)    Defective portion of the equipment, if found during warranty period shall be replaced within 30 days on receipt of intimation from the laboratory at the cost of the supplier. 

(xviii)   In case of any dispute, the contract shall be interpreted in accordance with the laws of Union of India.

(xix)     The competent authority reserves the cancel the quotation/tender in part or in full without assigning any reason thereto.
