         Sub:-Clarification for working of Custom House

              Agents under Regulation 9(2) of CHALR-2004.

 

         Attention of all Importers, Exporters, Custom House Agents, Shipping Agents and Members of the Trade are invited to Public Notice No. 26/2006   dated 29.03.2006 where in a copy of Customs Notification No. 37/2006 (N.T.) dated 27.03.2006 was circulated.

         

As per Notification No. 37/2006 (N.T.)dated 27.03.2006, the Port of Gujarat Adani Port Limited, Mundra, in the district  of Kutch  is placed under the jurisdiction of Commissioner of Customs, Kandla  w.e.f.01.04.2006. The  Commissioner of Customs, Kandla as  such is the Commissioner for both the Custom stations.  Thus, in terms of provisions of Regulation 9(2) of CHALR-2004, once intimation has been filed in Form-C  for either of the Customs station, the same shall hold good for both the Customs stations. However, before commencing work, the CHAs should register with the E.D.I. Systems of the Customs station concerned.

    

All the CHAs working at GAPL Mundra  are required to get fresh registration number from CHA Section of Kandla Custom House by submitting copy of intimation in Form-C filed by them with the Commissioner of Customs, Jamnagar/copy of licence in Form-D  as the case may be,  alongwith copy of permission letter issued from the office of the Commissioner of Customs, Jamnagar and copy of PAN number. This registration number should then be registered at both the EDI Centre at C. H. Kandla and GAPL Mundra by producing copy of permission letter issued by the Assistant Commissioner (CHA), C. H. Kandla /Licence in Form-D as the case may be, alongwith Annexure-A of Public Notice No.17/2004 dated 29.06.2004. Similarly, the CHAs already working at C. H. Kandla should simply register their old number at EDI centre, GAPL Mundra by producing copy of permission letter issued by the Assistant Commissioner (CHA), C. H. Kandla / Licence in Form-D as the case may be, alongwith Annexure-A of Public Notice No. 17/2004 dated 29.06.2004. All such fresh registration number should be applied between 17.04.2006 to 28.04.2006 so that relevant changes can be effected in EDI system in the evening of 28.04.2006 to avoid any difficulty to CHAs. The CHAs having different registration numbers for two Custom Stations should retain Kandla number and get it registered at Mundra and subsequently they should surrender their Mundra registration number. In case any CHA holding parent licence at other Custom Station wants to commence business at the ports under the jurisdiction of Commissioner of Customs, C. H. Kandla as per the provisions of Regulation 9(2) of CHALR-2004, he may submit his intimation in Form-C to the CHA section in C. H. Kandla alongwith copy of parent licence and PAN number.   

 

           All the Trade Associations / Chamber of Commerce / Members of Regional Advisory Committee and Custom House Agents’ Association are requested to publicize the contents of this Public Notice among their members / constituents.
